XnFun Privacy and Security Policy
The Company attaches great importance to the privacy of users. In order to protect your rights and interests. 1. How we collect information
1.1 The information directly provided to us by you
1.1.1 Your username, passwords and email address when registering for an XnBay account.
1.1.2 Personal profile information provided by you (e.g. email address and nickname). Such information allows us to help you or other users be located on XnBay.
1.1.3 The user content (such as photos, album titles, name tags, comments and other information) you post on XnBay.
1.1.4 Communications between you and XnBay. For example, we may send you emails related to the Service (e.g., account verification, functional changes/updates to the Service, technical or security-related notices). Please note that you may not opt-out of receiving emails related to the Service.
1.1.5 You may also provide us with the email addresses of your contacts when sharing albums, photos or videos. We may also receive personal information (e.g., your email address) from other users. For example, when they try to share content with you or attempt to recommend XnBay to you.
1.2 Cookies and similar technologies
We use cookies and similar technologies, including local storage, for the following purposes:
1.2.1 Assist us in maintaining your use of the Service as you use it;
1.2.2 Improve security;
1.2.3 Memorize your browser and related information about your preferences;
1.2.4 Help us to understand the use of the Service by users and improve the Service quality; For example, we may use Google Analytics to assist us for such purpose. By continuing to use the Service, you agree to our use of cookies and similar technologies in accordance with the Privacy Policy. Please note that most browsers allow you to choose whether to use cookies. However, if you clear cookies or restrict the functioning of cookies, you may not be able to use some or all of the functions, which would affect your overall user experience.
1.3 Record files information
When you use XnBay Service or browse our website, we may obtain and save certain electronic identification and log data from your mobile device or personal computer, such as: type of operating system, IP address, browser information, including type and language settings, device ID or mobile app ID.
When using the XnBay Service, our server automatically records your interaction with the Service, the domain name, the linked page, the page viewed, and other such kinds of information. We may also collect similar data from emails sent to users to help us track which emails recipients open or which links they click. Such information enables more accurate reporting and improvement of the Service.
1.4 Device ID
When you use a mobile device such as a tablet or mobile phone to access our Service, we may access, collect, monitor, store, and/or remotely store one or more "Device IDs" on your device ". Device IDs are small data files or similar data structures that are stored on or associated with your mobile device for clearly identifying your mobile device. The data of the device ID may be stored on the hardware of the device in a related manner, stored in the operating system or other software in a related manner, or transmitted to the device by XnBay.
1.5 Metadata Metadata usually refers to technical data related to user content. For example, metadata can describe how a specific user content is collected, the collection time, who collects it, and the format of such content.
1.5.1 Users may add metadata to user content, including hashtags (such as marking keywords when posting photos), location tags (such as marking the location of photos), name tags (such as marking avatar names), album titles, comments or other information. This can allow your user content easier to be found and more interactive.
1.5.2 If you add a location tag to a photo or use other’s API to tag a photo, your location's latitude and longitude coordinates will be stored along with such photo.
1.6 Contact information for customer support
In some cases, you may wish to contact us for customer support services. If you contact us through our contact form or otherwise, we may obtain and store any information you choose to provide, including contact information such as your name, email account and phone number, and the type of device and operating system for your mobile device or personal computer. We will use such information to process and investigate issues you have forwarded to us to provide you with support and improve our customer support services.
Definitions --- "User Generated Content"
1.7 Your personal data (i.e. nicknames, personal photos and phrases displayed in nicknames), texts and audio information, photos, videos, geolocation information, or the contact information of your XnBay friends, and the content shared with other users, which you generate from your use.
1.7.1 When you create certain information, you may choose the scope of the "User Generated Content" you want to share and with whom by setting the recipients in your "User Generated Content" and/or in the XnBay APP.
2. How we use your information
In order to provide Service, as a data controller or joint controller, XnBay will use your information for the following purposes:
2.1 For providing Service to you via mobile phone or PC, and you may send your "User Generated Content" to other XnBay users;
2.2 For verifying your identity;
2.3 For memorizing the data so that you don't have to re-enter it during your access or next time you access the XnBay Service;
2.4 For allowing you to use your XnBay account on a variety of terminal devices, or transferring your XnBay account to other terminal devices;
2.5 For helping you to find other XnBay users you know and keeping them in touch using XnBay, and also allowing other XnBay users to get in touch with you if you so request;
2.6 For enabling you to synchronize other APPs provided by XnBay, XnBay affiliates and XnBay business partners to your account, and to share information among the multiple APPs you use;
2.7 For providing, improving, testing and monitoring the effectiveness of our Service;
2.8 For discovering and stopping unauthorized use of XnBay Service, improper access to Service or abuse of XnBay Service;
2.9 For improving the standard of our Service and/or optimizing the quality of our Service;
2.10 For providing you with information related to XnBay Service;
2.11 For developing and testing new products and features/functions;
2.12 For accumulating anonymous statistical data related to the Service;
2.13 For monitoring metrics such as total visitors, traffic flows, and App activities distribution;
2.14 For diagnosing or correcting technical problems;
2.15 For ensuring customer support is provided to respond to your queries or claims in a timely and effective manner;
2.16 For conducting customer satisfaction surveys;
2.17 For updating XnBay APP on your device;
2.18 For notifying users of other important information related to XnBay Service when necessary.
2.19 XnBay or other users may host contests, special offers or other events through XnBay ("Events")
2.19.1 If you choose to participate in any Events, we may ask you to provide your contact details (such as name, mailing address, phone number, email account, gender and date of birth) for Event management such as confirming eligibility for participation, which enables you to fill out survey questionnaires and the delivery of prizes to you.
2.19.2 If you do not wish to participate in the Event, you shall use specific metadata associated with such Event (i.e. hashtags or location tags)
3. Sharing of your information
We will not lease or sell your information to any third parties outside of XnBay (or a group of companies to which XnBay affiliates) without your consent, except as specified in the Policy.
3.1 With whom we may share your information
3.1.1 We may share user content and your information (including but not limited to information from cookies, record files, device ID, location data and usage data) to legal companies of the group that XnBay affiliates to (hereinafter referred to as "affiliates"). Affiliates may use such information to assist in providing, understanding and improving the Service (including by providing analytics) and the affiliates’ own services (including providing you with a better and more relevant experience). However, these affiliates shall respect your right to decide who may view your photos.
3.1.2 We may also provide your information and information obtained by tools such as cookies, record files, device ID and location data to the third-party organizations (hereinafter referred to as "service providers") who assist us in providing Service to you. It is your responsibility to protect your own passwords and account information from being leaked at all times and control the access to emails between you and XnBay. Privacy settings may also be affected when changes are made to the social media services you connect to XnBay. We are not responsible for the functionality, privacy or security measures of any other organization.
5. Rights of choices regarding your personal data
5.1 You may directly check, correct, hide or delete your personal information through your XnBay APP. In addition, if we hold your personal information, you can make a written request in a statutory manner to check, correct, hide or delete any of such personal information we hold, which cannot be directly confirmed in the XnBay APP. Once your identity has been verified, we will respond to your request within a reasonable period of time in accordance with relevant legal requirements. We are not responsible for the practices of any sites or services linked to the Service, including the information and content they contain. Please note that when you use links from the Service to other sites or services, our Privacy Policy does not apply to those third-party sites or services. Your browsing and interaction with any third-party sites or services (including those linked to our Site) shall be governed by the rules and policies established by such third party. In addition, you agree that we are not responsible for and have no control over any third parties you authorize to access your user content. 7.1 XnBay APP provides photo identification and classification and photo-related technical services, and does not assume legal responsibility for the ownership or content of all photos using XnBay products and/or services.
7.2 XnBay shall not be liable for any interruptions or other defects of XnBay products and/or services caused by any factors of force majeure, but will try to do its best to mitigate the losses and impacts caused to users.

XnFun Terms of Use
Special Reminder: Before you (hereinafter referred to as the "User") begin to read and decide whether to accept the Terms of Use (hereinafter referred to as the "Terms"), the Company hereby reminds you to pay additional attention to the Articles 2, 4, 7, 8, 10, and 11 and the attachment regarding the personal privacy and security policy statement. Welcome to XnFun's products and services (hereinafter referred to as the "Service").

1. Definitions

1.1 "Content" refers to the contents such as texts, voice, music, pictures, videos, software, programs, codes and other information.

1.4 "XnFun Content" refers to the contents contained in the Service that is owned or authorized by the Company. 1.6 "User" refers to an individual user or any user on behalf of a business operator who chooses to accept all the terms and conditions after carefully reading the Terms.
2. Expression of consent to the Terms
2.1 The User shall use the Service in accordance with the provisions of the Terms. The use of the Service is not permitted unless the User has validly and irrevocably agreed to the Terms.
2.2 If the User is a minor or under guardianship, he/she shall obtain the consent of the legal representative before using the Service. 4. Restrictions on Use
The User is not allowed to engage in the following activities when using the Service:
4.1 Posting, submitting or transmitting content through the Service that is excessively violent, sexually suggestive, sexually explicit, related to race, nationality, belief, gender, social status, family background and other related discrimination, induces or promotes suicide, self-harm behaviors or manifestations of substance abuse, other repulsive manifestations, including anti-social elements.
4.2 Acts that may endanger public order or good morals.

4.6 Alter, modify, adapt or change the Service or other websites which would cause the misunderstanding that the website is related to the Service or the Company. Or pretend to be the staff of the Company or any third party or intentionally spread false information.
4.7 Acts of sending the commercial or harassment messages of the same formats (also known as "spam messages") to an unspecified majority of Users (except with the consent of the Company), or randomly adding other Users as friends, and randomly posting messages in groups.
4.8 Interfere with or affect the Service or the servers and networks connected to the Service, including transmitting any computer worms, viruses, spyware, malware and other destructive or disruptive codes. Insert contents or codes, alter or interfere with the way the Service is rendered or displayed on the User’s browser or device.
4.9 Use cheating kits or other technical means to operate the Service improperly, or the intentional use of loopholes in the Service, repeat the same question(s) beyond the tolerable level to make improper inquiries or requests to the Company, or other acts that hinder the Company’s operation of the Service or the use of the Service of other Users, and generation of interference.
4.10 Create the account on the Service by unauthorized means, including but not limited to the use of automatic devices, scripts, automated programs, spider programs, cataloging programs or retrieval programs.
4.11 Attempt to prevent other Users from using or enjoying the Service, or encourage or provide a way to violate these Terms or other "Individual Terms of Use".
4.12 Access any content of the Service by automated means of cataloging, retrieving, caching, etc., including but not limited to user profiles and photos (unless it is explicitly agreed by the Company or results retrieved by the search engine using standard search engine protocols or techniques).
4.13 Acts that violate legal provisions, decrees, court judgments, rulings or orders or legally binding administrative measures.
4.14 Remove, alter or hide any copyright, trademark, service mark or other proprietary notices that contain or accompany the XnFun content; or reproduce, modify, adapt, create derivative works, perform, display, publish, distribute, transmit, broadcast, sell, license, or engage in other exploitative practices.
5. User's Responsibilities
5.1 When using the Service, if the User has any relevant information about the registered user, he/she shall provide true, correct and complete information. You agree to update the information as necessary to maintain its truthfulness and accuracy.
5.2 You are responsible for any activity that occurs through your account, and the account of the Service shall be exclusive to the individual user. All the User’s rights to use the Service shall not be assigned to, lent to or inherited by any third party. Unless you are expressly authorized to create an account on behalf of an employee or business owner, you are prohibited from creating an account for anyone other than yourself when using the Service, and you shall explicitly agree not to do so.
5.3 When using the Service, the User shall be responsible for protecting the confidentiality and security of his/her passwords to avoid improper use. All actions using the password shall be regarded as the actions of the User.
5.4 You agree to abide by all laws and regulations applicable to the use of the Service and your submissions, including but not limited to Copyright Act.
5.5 You shall be solely responsible for all your actions and results on the Service, including but not limited to your interactions with other Users of the Service (regardless of online or offline) and all of your submissions.
5.6 You may not use "XnFun" or the website address in your user name without the Company's prior written consent.
5.7 For the use of the Service, the User shall prepare necessary personal computers, mobile phones, communication equipment, operating systems, communication methods and electricity, etc. at his/her own expense, and shall pay for all data transmission fees arising from the use of the Service.
6. Rights Reserved by the Company
6.1 In the event that the User violates these Terms of Use, or has the potential violation, or otherwise causes harm or possible legal risk to the Company, the Company may, at its sole discretion, terminate the User’s account for using the Service, or cease to provide partial or all of the Service. The Company may do so without further notice and will have no liabilities to the User. However, it does not indicate that the Company is obliged to prevent or correct such violations.
6.2 The Company reserves the right to modify or terminate the Service at any time for any reason, or to refuse to allow anyone, including but not limited to Users of the service, to access the Service. The Company reserves the right to forcibly confiscate any user name for any reason.
6.3 The name and logo of XnFun are trademarks of the Company and may not be copied, imitated or used in part or in whole without the Company’s prior written consent. This does not apply to those who comply with our brand guidelines. In addition, all web page titles, custom images, button icons, scripts are service marks, trademarks and/or XnFun's trademark images may not be copied, imitated or used (including reproductions) in whole or in part without the prior written consent of the Company (including remake, transmission, reproduction, and modification).
6.4 We will continue to amend and improve the “Service”. We may add or remove functions or features, and we may suspend or discontinue any specific item of the “Service” entirely.
7. Disclaimers and Limit of Liabilities
7.1 The Service is provided to you on an "as is" and "potentially defective" basis, and you shall bear all risks in terms of quality and performance of the Service. The Company expressly states that it does not provide any express, implied or regulatory guarantee for the Service, including but not limited to implied or regulatory guarantees of its security, reliability, correctness, completeness, effectiveness, and applicability to any specific purpose, and free from any error or program error, and no infringement of any intellectual property rights. This indicates that the Company will not promise you that the Service is completely free of problems, and has no obligation to provide the Service to users by removing all such defects.
7.2 Although the Company provides the User’s Code of Conduct in these Terms, it does not bear any liabilities of indemnity for the content of the submissions, and specifically any loss or damage (whether actual, derivative, punitive or any other cause and nature) injury, claim, or complaint caused to any person or entity, and the Company shall be exempted from all compensation generated by equity laws.
7.3 Even if the Company has been informed of the possibility of such damages, the Company’s total liability arising from the Service shall not exceed the usage fee amount it collects from the Users in the month in which the damage occurred.
7.4 However, some jurisdictions allow no exclusion of certain guarantees, nor the limitation or exclusion of liabilities for certain losses. Therefore, some of the above disclaimers and limitations of liabilities may not apply to you. Under applicable laws and regulations, if the Company does not disclaim any implied warranties or limit its liabilities, the scope of the Company’s liabilities during and duration of such guarantees shall be limited to the minimum amount permitted by such applicable laws and regulations.
8. Authorization by User
8.1 The Service may have functions that most Users can edit such as submission, modification, and deletion, etc. In these cases, the User agrees that other users may edit the contents it submits.
8.2 The User shall ensure that he/she owns all rights to the content of the submissions or has obtained all the necessary rights in the content of such submission. The User can grant the relevant rights of the content of such submission the Company. 9.1 The Company does not own any content submitted by Users. The Company grants the User the right to use the content provided by the Company, which is not transferable or sublicensable, and is non-exclusive and is for the sole purpose of using the Service.
9.2 Once the account is terminated, all licenses and other rights granted to you by the Terms of Use will cease immediately. Please note that the original account cannot be restored even if the User accidentally deletes such account.
9.3 Some links or messages you receive may come from the Service, and these links may lead to third-party websites or features. In addition, some links to third-party websites or features may exist on the Service in the form of images or comments. However, the Company provides no backup service, and you agree not to rely on the Service for content backup or storage.
9.5 It is the Company’s policy not to accept or consider content other than those expressly stated by us, and which may be subject to certain terms and conditions. This is to avoid any misunderstanding that your idea is identical to another idea we have developed or independently developed. Therefore, the Company does not accept information or ideas proactively provided and is not responsible for any such information or ideas. If, in disregard of our policies, you decide to use the Service to transmit content, materials, ideas, suggestions or other materials to us, you further agree that the Company may use such content, materials, ideas, suggestions or other materials at will for various purposes, including but not limited to developing and marketing products and services, without any providing any compensation or expense to you.
10. Indemnity
You (and any third party for whom you operate accounts or activities on the Service) agree and warrant to indemnify and hold the Company harmless against any liabilities of any damages, losses, and expenses, including but not limited to reasonable attorneys’ fees and expenses, arising out of any claims due to your use of the Service (including, but not limited to, your direct activities on the Service, or by your agent). You agree to cooperate fully with the Company's requirements in the defense against any of such claims. The Company reserves the exclusive right to deal with the indemnity caused by you, and without the Company’s prior written consent, you shall not settle with the other party to any claim.
11. Governing laws and jurisdiction of disputes
11.1 The Chinese version of the Terms shall prevail, and the governing laws shall be the laws of the Republic of China. These applicable laws may be amended from time to time. Therefore, if the amendment in such applicable laws results in an increase or decrease in the rights and interests of Users and/or the Company under these Terms, it does not constitute a basis for the natural invalidity or termination of enforceability of all or a provision of these Terms, unless such applicable laws as amended is a mandatory provision of effect.
11.2 For any dispute between the User and the Company arising from or related to the Service, subject to that the applicable laws and policies allow the jurisdiction where the Company is located to be the sole or one of the governing jurisdictions, the User agrees to the exclusive jurisdiction of the local court of the jurisdiction where the Company is located. At the same time, when the Company intends to bring a dispute related to the Service against the User or other third parties, the Company shall be entitled to choose the local court with jurisdiction where the Company is located to have exclusive jurisdiction over such dispute.
12. Miscellaneous
12.1 Advertising: The Company may publish advertisements of the Company or any third party on the Service without obtaining the User’s consent or notifying the User.
12.2 Business partners services: This Service may include services or content provided by other business partners of the Company. The responsibilities for such services or contents shall be borne by the business operators providing the services or contents. The Company is not responsible for the services provided by the above-mentioned business partners. In addition, the terms of use and other conditions specified by the provider of the services or contents may apply to such services or contents.

2.1 用於透過手機或個人電腦為您提供服務，您可以將您的"使用者產生內容"發送給其他 XnBay 用戶;
2.2 用於核實您的身份;
2.3 記住資料，讓您在造訪過程中或下次造訪 XnBay 服務時，無需重新輸入;
2.4 使您可以在多種終端設備上使用您的 XnBay 帳戶，也可以移轉您的 XnBay 帳戶至其他終端設備上;

用戶存取或使用本服務，不論存取方式為何，即表示同意接受本條款約束。本條款會影響您的法律權利與義務。如果您不願全部接受本條款約束，請勿存取或使用本服務。
1. 定義
本條款使用下列各項用語：
1.1 「內容」係指文字、語音、音樂、圖片、影片、軟體、程式、代碼及其他資訊等 內容。

4. 使用限制規定
用戶使用本服務時不得從事下列活動：
4.1 透過本服務張貼、投稿或傳送內容有過度暴力的表現、性暗示過度露骨的表 現、涉及人種、國籍、信仰、性別、社會地位、家世等有關歧視的表現、引誘或助長自殺、自傷行為或濫用藥物的表現、其他包含反社會情節在內等使人感到不愉快的表現的行為。
4.2 可能危害公共秩序或善良風俗的行為。
4.3 透過本服務進行誹謗、跟蹤、脅迫、辱罵、騷擾、威脅、冒充、恐嚇其他人或機構的活動，或透過本服務張貼私人或機密資料，包括但不限於您或其他人的信用卡資料、社會安全或其他國家身分證字號、非公開的電話號碼，或是非公開的電子郵件信箱。
4.4 不當蒐集、公開或提供他人的個人資料、註冊資料、使用記錄資料等的行為。
4.5 使用本服務從事任何非法或未經授權的活動。包括但不限於以行銷、宣傳、廣告、招攬或其他營利為目的之行為（經本公司同意者除外）、以性行為或猥褻行為為目的之行為、以騷擾或毀謗中傷其他用戶為目的之行為、其他基於與本服務訂定的使用目的不同之目的使用本服務的行為。
4.6 改變、修改、改編或更改本服務，或是變更、修改或更改其他網站，以致於令人誤會該網站與本服務或本公司有關。或偽裝成本公司或第三人的行為或故意散佈不實資訊的行為。
4.7 傳送相同其他形式的商業或騷擾訊息（又稱為「垃圾訊息」）給不特定多數用戶的行為（經本公司同意者除外）、或隨機將其他用戶加入為好友，及隨意在群組留言的行為。
4.8 干擾或影響本服務或與本服務所連線的伺服器及網路，包括傳送任何電腦蠕蟲、病毒、間諜程式、惡意軟體等其他具有破壞性或干擾性的程式碼。置入內容或程式碼、更動或干擾任何本服務在用戶瀏覽器或裝置上的呈現或顯示方式。
4.9 利用作弊工具、其他技術性手段不當操作服務的行為、或故意利用本服務漏洞的行為、超出必要限度重複同一問題等對本公司提出不當洽詢或要求的行為、其他妨礙本公司經營本服務或其他用戶使用本服務，並製造干擾的行為。
4.10 透過未經授權的方式建立本服務的帳號，包括但不限於使用自動化裝置、指令碼、自動程式、蜘蛛程式、編目程式或擷取程式。
4.11 試圖阻止其他用戶使用或享受本服務，或鼓勵或提供觸犯本條款或其他「個別使用條款」的途徑。
4.12 透過自動化方式編目、擷取、快取等方式存取本服務的任何內容，包括但不限於用戶個人檔案和相片（除非是經本公司明確同意，由搜尋引擎使用標準搜尋引擎協定或技術所搜尋到的結果）。
4.13 違反法律規定、法令、法院判決、裁定或命令或具有法律拘束力的行政措施的行為。
4.14 移除、更改或隱藏任何包含或伴隨 XnFun 內容的著作權、商標、服務商標或其他所有權告示；或將 XnFun 內容重製、修改、改編、據以製作衍生著作、演出、展示、出版、散佈、傳送、廣播、出售、授權，或從事其他剝削行為。
5. 用戶責任
5.1 用戶於使用本服務時，如有註冊用戶本身相關資料，應提供真實、正確且完整的資料。您同意必要時更新資料，以維持其真實及正確性。
5.2 您必須對透過您帳號發生的任何活動負責，本服務的帳號專屬於用戶個人。用戶於本服務的所有使用權皆不得轉讓、出借予第三人或使第三人繼承。除非經過明確授權，可代表員工或業者建立帳號，否則使用本服務時，禁止替自身以外的人建立帳號，您也同意不會這麼做。
5.3 用戶於使用本服務時，有責任保護自己的密碼機密性與安全性，以免遭到不當使用。利用該密碼所進行的一切行為均視為用戶本人的行為。
5.4 您同意遵守所有適用於與使用本服務及您的投稿內容相關的法令規章，包括但不限於著作權法。
5.5 您需全權負責自己在本服務所從事的所有行為及其結果，包括但不限於與本服務其他用戶的互動行為（無論是在線上或離線），以及您的全部投稿內容。
5.6 未事先取得本公司書面同意，不得在您的用戶名稱使用 “XnFun”或網址。
5.7 用戶就本服務的使用，應自費備置必要的個人電腦、手機、通信設備、作業系統、通信方式及電力等，並應自行支付因使用本服務所產生的所有數據傳輸費用。
6. 本公司權利保留
6.1 用戶違反本使用條款時，或有違反之虞時，或是以其他方式對本公司造成危害或可能的法律風險，本公司可全權酌情終止用戶使用本服務的帳號，或停止向用戶提供部分或所有本服務。無需另行通知，且不必對用戶承擔任何責任。但此不代表本公司有義務防止或糾正該等違反情形。
6.2 本公司保留因任何理由得以隨時修改或終止本服務，或是拒絕讓任何人，包括但不限於本服務用戶存取本服務的權利。本公司保有因任何理由強制沒收任何用戶名稱的權利。
6.3 XnFun 的名稱和標誌為本公司的商標，未經本公司事先書面同意，不得部分或全部複製、模仿或使用。符合我們的品牌準則規範者不在此限。此外，所有網頁標題、自訂圖片、按鈕圖示、指令碼均為服務標誌、商標和／或 XnFun 的商標形象，未經 本公司事先書面同意，不得部分或全部複製、模仿或使用(包括重製、傳送、轉載、更動等行為本內容)。
6.4 我們會持續不斷變更並改進「本服務」。我們可能會新增或移除功能或特性，也可能會完全暫停或停止某項「服務」。
7. 免責聲明與責任限制
7.1 本服務係依「現況」及「可能存在缺陷」的狀態提供給您，您需要承擔本服務在品質及效能方面的全部風險。本公司明確表示不為本服務提供任何明示、默示或法規的擔保，包括但不限於以默示或法規的形式擔保其安全性、可靠性、正確性、完整性、有效性、特定目的的適用性、錯誤或程式錯誤、以及未侵犯智慧財產權。這表示本公司無法向您承諾本服務完全沒有問題，亦無清除該等瑕疵後再向用戶提供本服務的義務。
7.2 儘管本公司在本條款中提供用戶的行為守則，但本公司並不替投稿內容背書，並特別聲明，對於任何人或實體因任何內容造成的損失或損害（無論是實際、衍生性、懲罰性，或任何其他原因及性質）、損傷、索賠、求償，本公司概不負責或賠償，亦免於一切衡平法賠償。
7.3 即使本公司已經被告知此類損害的可能性，本公司因本服務引起的總責任不會超過損害發生當月本公司自用戶收取的使用金額。
7.4 有些司法管轄區不允許免除某些擔保，亦不允許限制或免除對某些損失的責任。因此，上述某些免責聲明及責任限制條款可能不適用於您。 根據適用法律，若本公司未免於承擔任何默示擔保或未限制其責任，則本公司在此等擔保的範圍與持續期間內的責任金額應限於在該適用法律許可的最小金額範圍之內。
8. 用戶授權
8.1 本服務可能具備多數用戶可進行投稿、修改、刪除等編輯的功能。於此情形下，用戶同意其他用戶可編輯該用戶自行投稿的內容。
8.2 用戶應確保擁有其投稿內容之全部權利，或者已獲得投稿內容中的所有必要權利，使用戶可以將投稿內容之權利授予本公司。用戶在此授與本公司非獨家、已付清費用，而且免版稅、可轉移、可轉授權的全球性許可，使本公司有權以自認為恰當的方式或目的 (包括但不限於商業用途)，使用、散佈、重製、修改、調整、發佈、翻譯、公開執行及公開展示用戶依照本服務隱私政策規範投稿的內容，或使本公司有權展示與用戶投稿內容有關的廣告，以及將用戶投稿內容用於廣告或促銷目的。
9. 使用
9.1 本公司對用戶的任何投稿內容並無所有權。本公司就本公司所提供的本內容授予用戶使用權，此使用權並不得轉讓及再授權，且具有非獨占性，並以使用本服務為唯一目的。
9.2 一旦帳號終止，所有使用條款賦予您的許可及其他權利會立刻停止。即便是用戶不慎刪除帳號，原有的帳號亦無法回復，敬請留意。
9.3 有些連結可能來自本服務，或是您從本服務收到的訊息，且這些連結可能通往第三方網站或功能。此外，有些通往第三方網站或功能的連結，是以影像或留言形式存在於本服務中。本服務也包含我們無法控制、維護或背書的第三方內容。本服務的功能可能也會允許本服務與第三方網站或功能互動，包括將本服務或您在本服務的個人檔案連結到第三方網站或功能的應用程式。例如，本服務可能有某個功能讓您能分享放在本服務的內容，或是您放在第三方的內容，這些內容可能是您公開張貼在該第三方的服務或是應用程式中。使用這類功能時，通常會要求您登入您在第三方服務的帳號，但您在這麼做時需自行承擔風險。本公司並未掌控這些第三方網路服務或其任何內容。您明確知道並同意本公司完全無須為任何這類第三方服務或功能負責或賠償。您透過本服務進行的通信和商務交易完全是您和第三方之間的行為。您可以憑個人及絕對酌情決定權以及風險自負的情況下，選擇使用將本服務或您在本服務的個人檔案與第三方服務連結在一起的應用程式（稱為「應用程式」）。這樣的應用程式有可能與您在本服務的個人檔案互動、連結或從您的個人檔案蒐集並／或取出資料，或是傳送資料到您的個人檔案。使用這樣的應用程式時，您確知並同意下列事項：
(i) 如果使用應用程式分享資料，表示您同意自己在本服務的個人檔案資料被分享；
(ii) 您使用應用程式可能會造成個人識別資料公開，而且／或與您建立關聯，儘管本服務或本公司本身不曾提供這樣的資料；
(iii) 使用應用程式是您自己的選擇，您必須自行承擔風險，並確保與該應用程式相關之活動將免除對本公司帶來任何損害。
9.4 從本服務移除的內容可能會被本公司繼續儲存，理由包括但不限於配合某些法律義務，但可能要取得有效法庭命令才能取出這些內容。但是本公司並非備份服務，您同意不會依賴本服務作為內容備份或儲存之用。
9.5 本公司的政策是不接受或考慮我們明訂之外的內容，而且這些內容可能適用某些特定條款和規定。這是為了避免您的構想與我們已開發或獨立開發中的構想雷同，因而產生任何誤會。因此本公司並不接受主動提供的資料或構想，對任何這類資料或構想也概不負責。如果您無視於我們的政策，決定使用本服務傳送內容、資料、構想、建議或其他資料給我們，就表示您進一步同意本公司可任意使用這類內容、資料、構想、建議或其他資料，作為各種用途，包括但不限於開發和行銷產品與服務，無須給您任何賠償或費用。
10. 賠償
您（以及您在本服務代為操作帳號或活動的任何第三方）同意並保證本公司免於承擔由於您使用本服務（包括但不限於您在本服務的直接活動，或是您的代理人所造成的後果）帶來的任何索賠要求，免於賠償或負擔任何損害、損失責任及費用，包括但不限於合理的律師費用及支出。您同意在各種索賠抗辯中，全力配合本公司的要求。對於您造成的賠償事宜，本公司保留獨家全權處理權利，未經本公司事先書面同意，您不得與任何索賠案之對方當事人和解。
11. 適用法律與糾紛管轄地點
11.1 本條款以中文為準，其準據法為中華民國法律。該等適用法律可能處於動態變 化過程中，因此，若因適用法律發生變化，導致用戶和/或本公司在本條款項下的權益有所增減，均不構成本條款的全部或某個條款自然無效或終止可執行性的依據，除非發生變化的該等適用法律屬於效力性強制性規定。
11.2 用戶與本公司間所發生基於本服務或與本服務有關連的任何紛爭，只要發生糾紛時適用法律與政策允許將本公司所在地作為唯一或其中之一的糾紛管轄地的，則用戶同意由本公司所在地有管轄權的地方法院排他管轄該糾紛。同時，當本公司擬對用戶或其他第三方提起與本服務有關的糾紛時，本公司有權選擇本公司所在地有管轄權的地方法院排他管轄該糾紛。
12. 其他
12.1 廣告刊登：本公司得在本服務刊登本公司或第三人的廣告，無須取得用戶同 意或通知用戶。
12.2 業務合作夥伴服務：本服務內可能包含其他與本公司有業務合作的業者所提供的服務或內容。該等服務或內容所應負責任，概由提供服務或內容的業者負擔。本公司對上述業務合作夥伴所提供之服務不承擔任何責任。此外，提供服務或內容的業者所規定的使用條款及其他條件，可能適用於該等服務或內容。
12.3 聯絡方式
(i) 本公司向用戶聯絡本服務相關事項，以於 XnBay Technology 官網內的適當處公佈或其他本公司判斷為適當的方式進行。
(ii) 用戶向本公司聯絡本服務相關事項，請以 XnBay Technology 官網內的適當處所設置的問題反應表傳送或依本公司指定方式進行。

本プライバシーポリシーは、お客様がXnBay製品ウェブページ、XnBay APP(XnFun)で提供されるオプションサービス又はXnBay APPと統合或いは一緒に実行する他のAPP（以下、総称して「APP」という。）を使用する時に私たちに提供する個人情報、お客様が私たちが維持する又は私たちのAPPと関連するウェブサイト（以下、「ウェブサイト」という。）を閲覧する時に提供する個人情報（APPとウェブサイトを総称して「サービス」という。）、及びサービス利用者から提供されるお客様に関する個人情報に適用されます。ポリシーは、全ての訪問者、ユーザー及び本サービスにアクセスする者（以下、「ユーザー」という。）に適用されるものとします。
本プライバシーポリシーは、次の事項をご説明するものです。
• 収集する情報種類、収集理由、ルート、これら情報の利用・保存及び共有及びこれら個人情報に接触できる者。

• お客様の個人情報を収集する時、お客様に通知し、個人情報を収集する特定の目的を明確に示し、私たちがお客様の個人情報を収集、使用或いは開示することについてお客様の同意を求めます。

• 私たちは、お客様に対し責任を負い、私たちが上述の原則、本プライバシーポリシー及び準拠法を遵守する状況にいつでもご意見をお寄せください。
1. 情報収集ルート
1.1 お客様から直接ご提供いただいた個人情報。
1.1.1 お客様がXnBayアカウントを登録した時のユーザー名、パスワード、及び電子メールアドレス。
1.1.2 お客様からご提供いただいた個人プロファイル情報（例えば電子メールアドレス、ニックネーム）。これら情報により、XnBayにおいてお客様又は他のユーザーを見つけることができます。
1.1.3 XnBayに投稿するユーザーコンテンツ（例えば写真、フォトアルバム名、名前タグ、コメント及びその他の情報）。
1.1.4 お客様とXnBayの間の通信。例えば私たちは、本サービスに関連する電子メールをお客様に送信する場合があります（例：アカウント認証、本サービスの機能変更／更新、技術又は安全関連の通知）。お客様は、本サービスに関連するメールの受信をオプトアウトすることはできませんのでご注意ください。
1.1.5 お客様がフォトアルバム、写真又はビデオを共有する時、私たちに連絡者の電子メールアドレスを提供する場合もあります。私たちは、他のユーザーを介して個人情報（例えばお客様の電子メールアドレス）を受け取る場合があります。例えば彼らがお客様とコンテンツを共有しようとする場合、或いはお客様にXnBayをお勧めしようとする場合です。
1.2 Cookie及び類似技術
次の目的のため私たちは、Cookies及びローカルストレージを含む類似技術を使用します。
1.2.1 お客様がサービスを利用する時にお客様の使用状態を維持させるため。

XnBayサービスを利用又は私たちのウェブサイトを閲覧する時、私たちは、モバイルデバイス或いはパソコンから例えばOSタイプ、IPアドレス、ブラウザ情報(タイプと言語設定、デバイス識別子或いはモバイル応用識別子を含む）などの特定の電子ID及びログデータを取得すると共に保存する場合があります。
XnBayサービスを利用する時、私たちのサーバーは、お客様と本サービスリンクとのインタラクション状況、ドメイン名、リンクされたページ、見たページ及びこれらに準ずる情報を自動的に記録します。私たちは、ユーザーに送信する電子メールから類似の情報を収集して、受信者がどのような電子メールを開いたのか、又はどのようなリンクをクリックしたのかを追跡するのに役立てていきます。これら情報により、本サービスがより正確なレポートを得られると共に改善することができます。
1.4 デバイスの識別子
タブレットや携帯電話などのモバイルデバイスを使用して私たちのサービスにアクセスする場合、私たちはお客様のデバイスから1つ又は複数の「デバイスの識別子」にアクセスし、収集、監視、保存、並びに/又はリモートで保存する場合があります。デバイスの識別子は、モバイルデバイスに保存或いは関連付けられる小さなデータファイル又は類似のデータ構成で、お客様のモバイルデバイスを明確に識別できます。デバイスの識別子のデータは、関連の方法でデバイスのハードウェアに保存されるか、OS又は他のソフトウェアに保存されるか、XnBayによってデバイスに転送されます。
1.5 メタデータ。メタデータは、通常ユーザーコンテンツに関する技術的データです。例えばメタデータは、あるユーザーコンテンツ収集の方法、時間、収集者及びコンテンツの形式を説明することができます。
1.5.1 ユーザーは、hashtag（例：写真投稿時にキーワードを表示する）、場所タグ（例：写真場所を表示する）、名前タグ（例：プロファイル画像の名前を表示する）、フォトアルバム名、コメント又はその他の情報を含むメタデータをユーザーコンテンツ内に加えることができます。これによりユーザーコンテンツが他の人から検索されやすくなり、インタラクションもより良くすることができます。
1.5.2 写真に場所タブを加える、又は他の人のAPIで写真にタグを付けた場合、緯度経度座標が写真と一緒に保存されます。
1.6 カスタマーサポートの連絡先情報
状況によってはカスタマーサポートサービスが必要となり、お客様が私たちに問い合わせる可能性があります。問い合わせフォーム又はその他の方法でお問い合わせいただいた場合、私たちはお客様から提供された情報(お客様の名前、電子メールアカウント及び電話番号等の連絡先情報及び機器タイプとOSタイプなどのモバイルデバイス或いはパソコンの関連情報を含む)を取得及び保存することができます。私たちは、これらの情報を利用してお客様から伝達された問題を処理及び調査してから、お客様にサポートを提供し、カスタマーサポートサービスを改善していきます。
用語の定義 --- 「ユーザー生成コンテンツ」
1.7 お客様の個人情報（即ち、ニックネーム、個人の写真及びニックネームに表示されるフレーズ）、テキスト及びオーディオの情報、写真、ビデオ、地理的位置情報、又はXnBayの友だちの連絡先情報、かつ他のユーザーと共有し、お客様の使用によって生成されたコンテンツ。
1.7.1 情報を作成する時、「ユーザー生成コンテンツ」の受信者を設定する、及び/又はXnBay APPで設定することにより、共有したい「ユーザー生成コンテンツ」の範囲及び誰と共有するかを選択できます。
2. お客様の情報を利用する方法
サービスを提供するため、データ管理者又は共同管理者としてXnBayは、次の目的でお客様の情報を利用します。
2.1 携帯電話又はパソコンを介してお客様にサービスを提供するため。ユーザーは「ユーザー生成コンテンツ」を他のXnBayユーザーに転送できます。
2.2 本人確認のため。
2.3 アクセス中又は次回XnBayサービスにアクセスしたときに再入力する必要がないようデータを記憶するため。
2.4 様々な端末機器でXnBayアカウントを使用できるようにするため、又はXnBayアカウントを他の端末機器に移転できるようにするため。
2.5 知り合い以外のXnBayユーザーを見つけて、XnBayで連絡を取り合うのをサポートし、要求があった場合、他のXnBayユーザーがお客様と連絡を取ることを許可するようにするため。
2.6 XnBay、XnBay関係会社、及びXnBay業務提携パートナーが提供する他のAPPをアカウントに同期し、使用する複数のAPP間で情報を共有できるようにするため。
2.7 私たちのサービスのパフォーマンスを提供、改善、テスト、及び監視するため。
2.8 XnBayサービスの無許可使用、サービスへの不適切なアクセス、又はXnBayサービスの悪用を発見及び阻止するため。
2.9 私たちのサービス水準を向上し、及び/又はサービス品質を最適化するため。
2.10 XnBayサービスに関連する情報をお客様に提供するため。
2.11 新製品及び新機能の開発とテストのため。
2.12 サービス関連の匿名化された統計データを蓄積するため。
2.13 訪問者の総数、トラフィック、及びAppアクティビティ分布状況などの測定指標を監視するため。
2.14 技術的な問題を診断又は修正するため。
2.15 カスタマーサポートを提供し、お客様からの質問やクレームに適時かつ効果的に回答するため。
2.16 顧客満足度調査を実施するため。
2.17 デバイス上のXnBayアプリをアップデートするため。
2.18 必要に応じて、XnBayサービスに関連するその他の重要情報をユーザーに通知するため。
2.19 XnBay又はその他のユーザーが、XnBayを通じてコンテスト、特典、又はその他の活動（以下、「活動」という。）を開催するため。
2.19.1 活動への参加を選択した場合、これら活動を管理(これら活動に参加する資格を確認することで、アンケート調査票に記入できるようにすると共に賞品を届ける)するため、詳細な連絡先情報（例：名前、住所、電話番号、電子メールアカウント、性別、及び生年月日）の提供をお願いする場合があります。
2.19.2 活動に参加したくない場合、当該活動に関連する特定のメタデータ（つまり、ハッシュタグ又は場所タグ）を使用しないでください。
3. お客様の情報の共有
お客様の同意を得ることなくXnBay以外の第三者（又はXnBayが所属する企業グループ）にお客様の情報を貸与又は売却することはありません。ただし、本ポリシーに明記されている場合、この限りではありません。
3.1 私たちがお客様の情報を共有する対象者
3.1.1 私たちは、ユーザーコンテンツ及びお客様の情報（Cookie、ログファイル、デバイス識別子、位置情報、及び利用状況の情報を含むがこれらに限定されない）を、XnBayが属する同じグループの法定企業（以下、「関係会社」という。）と共有する場合があります。関係会社は、この情報を利用して、本サービス（分析の提供を含む）及び関係会社自身のサービス（より良好で関連性の高いユーザーエクスペリエンスの提供を含む）の提供、理解、及び向上を支援する場合があります。ただし、これらの関係会社は、お客様の写真を誰に見せるかを決定するお客様の権利を尊重します。
3.1.2 私たちは、お客様の情報及びCookie、ログファイル、デバイス識別子、位置情報などのツールによって入手された情報を、ユーザーへのサービスの提供を支援する第三者機関（以下「サービスプロバイダ」という。）に提供する場合があります。私たちのサービスプロバイダは、サービスを提供するため、合理的かつ必要な場合において、合理的な秘密保持条項の規定を遵守したうえ、お客様の情報にアクセスすることが許可されます。
3.1.3 私たちは、お客様を特定できる情報部分を削除し、匿名データを他のパートナーと共有します。お客様のデータを他の情報と併合して、情報がお客様に関連しなくなるようにし、そして取りまとめた情報を共有する場合もあります。
3.2 ユーザーコンテンツを共有する対象者が選択可能
3.2.1 自発公開方式で本サービスに投稿したデータ又はコンテンツ（例えばユーザーコンテンツ）は、お客様が設定したプライバシー設定に従って公衆の利用に提供されます。本サービスでのプライバシー設定を変更するには、プロファイル設定を変更してください。ユーザーコンテンツを共有又は公開した場合、他のユーザーがこの部分のコンテンツを再共有できます。
3.2.2 プロファイル及びプライバシー設定に従いお客様が公開するユーザーコンテンツは他のユーザーによって検索される可能性があります。
3.2.3 他の人と共有する「ユーザー生成コンテンツ」は、デジタルデータの特性があるため受信者にコピー、保存、又は配布され、並びに他の意図しない受信者に見られる可能性があることに留意してください。情報又はコンテンツを作成、共有する際には、これらについて細心の注意を払ってください。
3.3 XnBayサービスに投稿されたデータを削除しても、副本はXnBayサービスのキャッシュ又はアーカイブされたページでまだ見られる可能性があります。このデータは、他のユーザー或いはXnBayアプリインターフェースを使用した第三者アプリによってコピー又は保存された可能性もあります。私たちは、お客様の同意を得て、お客様の情報を第三者アプリと共有する場合があります(例えばお客様がこのようなアプリを介して私たちのサービスにアクセスすることを選択した場合)。私たちは、これらの第三者アプリがお客様の情報をどのように取り扱うかについては責任を負いません。そのため、お客様は、当該アプリを信頼し、受け入れられるプライバシーポリシーを有していることを確認する必要があります。

4. お客様の情報の保存方法
4.1 本サービスを通じて収集されたお客様に関する情報は、関係会社及びサービスプロバイダが施設を持っている他の国で保存され、取り扱われる場合があります。安全で信頼性の高いサービスを提供するため、XnBayの情報処理と保存は、世界中の他の国にある安全なサーバー上で行われる場合があります。私たちのサービスを継続して利用することにより、お客様は、情報が越境移転されることに同意し、XnBayが、お客様が送信した国以外の国で情報を取り扱うと共に保存することに同意したものと見なされます。
4.2 電子伝送又はデータ保存の方法は非の打ちどころがないため、私たちは、お客様の情報がシステムでの伝送又は保存中100％安全であり、攻撃されないことを保証することはできません。
4.3 協力のため実行すべき事項を適切に行ってください。お客様はご自分のパスワードとアカウント情報が漏洩しないように随時保護し、ご自分とXnBay間の電子メールへのアクセスを管理する責任があります。XnBayに接続するソーシャルメディアサービスで変更が行われた場合、プライバシー設定も影響を受ける可能性があります。私たちは、他の組織の機能、プライバシー、又はセキュリティ対策について責任を負いません。
5. ご自分の情報に関する選択権利について
5.1 XnBay APPを介して、個人情報を直接確認、訂正、非表示、又は削除できます。また、私たちがお客様の個人情報を保有している場合、法定の方法で私たちが保有し、XnBayAPPで直接確認できないその他の個人情報の確認、訂正、非表示、又は削除を請求する書面を出すことができます。本人確認が完了した場合、関連する法律の要求に従い、合理的な期間内にお客様の請求に対応します。個人情報の確認、訂正、非表示、削除をご希望の場合、私たちのサービスメールアドレス又は電話でご連絡ください。
5.2 アカウントの終了又は停止後、XnBay、関係会社、又はサービスプロバイダは、情報（プロファイルデータを含む）及びユーザーコンテンツを最も商業的に有益な期間保持して、バックアップ、アーカイブ、及び/又は監査に使用します。
5.3 以下の目的で合理的に必要な場合、お客様のアカウントが閉鎖された後も、私たちはお客様の個人情報を保持し続けます。
5.3.1 準拠法の規定に適合させる、又は法的義務を履行するため。
5.3.2 カスタマーサポートサービスを提供及び完成させるため。
5.3.3 XnBayユーザー間、又は会社とユーザー間の紛争を解決するため。
5.3.4 サービスの無許可使用、不適切な使用、又は悪用を検出又は阻止するため。
6. その他のウェブサイト及びサービス
私たちは、本サービスにリンクされているウェブサイト又はサービスが実施するアプローチ(これらに含まれる情報及びコンテンツを含む)について、責任を負いません。本サービスから他のウェブサイト又はサービスへのリンクを使用する場合、私たちのプライバシーポリシーはこれらの第三者のウェブサイト又はサービスには適用されないことに留意してください。第三者のウェブサイト又はサービス（私たちのウェブサイトにリンクされているものを含む）の閲覧及びインタラクションは、当該第三者が定めるルール及び方針に準拠します。またお客様は、ユーザーコンテンツへのアクセスを許可した第三者に対して、私たちが責任を負わず、管理権を有しないことに同意するものとします。第三者ウェブサイト又はサービスを利用し、ユーザーコンテンツへのアクセスを許可する場合、お客様は自らリスクを負担することになります。

7.1 XnBay APPは、写真の識別・分類、及び写真関連の技術サービスを提供し、XnBay製品及び/又はサービスを利用する全ての写真の所有権或いはコンテンツに対して法的責任を負うことはありません。
7.2 XnBayは、不可抗力によるXnBay製品及び/又はサービスの中断或いはその他の欠陥に対して責任を負わないものとしますが、ユーザーに生じる損失及び影響を最小限に抑えるよう尽力します。

XnFun利用規約
特別注意：お客様（以下、「ユーザー」という。）は本『利用規約』（以下、「本規約」という。）を読み、受け入れるかどうかを決定する前、第2、4、7、8、10、11条項の内容及び付属書の個人プライバシー・セキュリティポリシーステートメントに特に留意してください。本規約内の全ての見出しは、検索の便宜上設けられたものです。
はじめに
XnFunの製品及びサービス(以下、「本サービス」という。)をご利用いただきありがとうございます。
本サービスは、携帯電話の写真、ビデオ、音楽、及びファイルをバックアップし、オリジナルな最高解像度で互いに転送や共有するサービスをユーザーに提供することを目的としています。
アクセス方法を問わず、ユーザーは本サービスにアクセス又は利用することにより、本規約に拘束されることに同意するものとします。本規約は、お客様の法的権利と義務に影響を与えます。お客様が本規約に完全に拘束されることを望まない場合、本サービスにアクセスしたり、本サービスを利用しないでください。
1. 定義
本規約では、以下の用語を使用します。
1.1 「コンテンツ」とは、文章、音声、音楽、画像、動画、ソフトウェア、プログラム、コードその他の情報などのことをいいます。
1.2 「本コンテンツ」とは、本サービスを通じてリンクすることができるコンテンツのことをいいます。
1.3 「投稿コンテンツ」とは、ユーザーが本サービスに共有、構築、アップロードしたコンテンツのことをいいます。
1.4 「XnFunコンテンツ」とは、当社が所有又は使用を許可している本サービスに含まれるコンテンツをいいます。XnFunコンテンツは、著作権法、商標法、特許法、営業秘密法などの法令によって保護され、ユーザーと当社の間で、当社はXnFunコンテンツ及び本サービス内の全ての権利を所有、保有します。
1.5 「個別利用規約」とは、本サービスに関して、本規約とは別に規約、ガイドライン、ポリシーなどの名称で当社が配付又は掲示している文書をいいます。
1.6 「ユーザー」とは、本規約を注意深く読んだ後、利用規約の全てを受け入れることを選択した利用者又は事業者を代表する利用者をいいます。
2. 規約への同意
2.1 ユーザーは、本規約の定めに従って本サービスを利用しなければなりません。ユーザーは、本規約に有効かつ取消不能な同意をしない限り本サービスを利用できません。
2.2 ユーザーが未成年者又は後見開始と宣告された場合、親権者等の法定代理人の同意を得たうえで本サービスを利用してください。またユーザーが、本サービスを事業者のために利用する場合、当該事業者も本規約に同意したうえで本サービスを利用してください。
2.3 ユーザーは、本サービスを実際に利用することによって、本規約に有効かつ取消不能な同意をしたものと見なされます。
2.4 「本サービス」の種類は多いため、一部の「サービス」には、個別利用規約又は製品規定(年齢制限を含む)がある場合があります。個別利用規約は、関連する「サービス」とともに提供されます。「サービス」を利用する場合、本規約に加えて、ユーザーも個別利用規約に従ってサービスを利用しなければなりません。
2.5 「サービス」の一部では、コンテンツのアップロード、送信、保存、転送又は受信が可能です。お客様は、関連するコンテンツ内の所有する知的財産権を保有します。簡単に言えば、お客様のものは、やはりお客様のものということです。
2.6 「本サービス」にコンテンツをアップロード、送信、保存、転送する場合、又は「本サービス」でコンテンツを受信する場合、或いは「本サービス」を通じて上述の操作を行うと、当社（及び当社の関係会社）に共通の利用許諾を与え、派生作品（お客様のコンテンツを識別、改編又は変更して私たちの「本サービス」により適合させる）を使用、管理代行、保存、再製、修正、作成でき、このようなコンテンツを配布、リリース、公開操作、公開展示、及び頒布できることを示します。この利用許諾で付与する権利は、本サービスの運営、宣伝や改善、及び新しいサービスの開発の使用に限定されます。
3. 規約の変更
当社は、当社が必要と判断する場合、あらかじめユーザーに通知することなく、いつでも、本規約及び個別利用規約を変更できるものとします。変更後の本規約及び個別利用規約は、XnBay Technologyが運営するウェブサイト内の適宜の場所に掲示された時点から効力を生じるものとします。ユーザーは、本規約及び個別利用規約の変更後も本サービスを使い続けることにより、変更後の本規約及び適用する個別利用規約に対する有効かつ取消不能な同意をしたものとみなされます。関係する変更の内容をユーザーに個別に通知することはいたしかねますので、本サービスをご利用の際には、随時、最新の本規約及び適用する個別利用規約をご確認ください。
4. 禁止事項
ユーザーは、本サービスの利用に際し、以下の行為を行ってはなりません。
4.1 本サービスを通じて過度に暴力的な表現、露骨な性的表現、人種、国籍、信条、性別、社会的身分、門地等による差別につながる表現、自殺・自傷行為・薬物乱用を誘引又は助長する表現、その他の反社会的な内容を含み他人に不快感を与える表現を、掲示、投稿又は送信する行為。
4.2 公の秩序又は善良の風俗に反するおそれのある行為。
4.3 本サービスを通じて、他人や機関を誹謗、ストーカー行為、強迫的、罵倒、嫌がらせ、脅迫、なりすまし、恫喝する行為、又は本サービスを通じてご自分や他人のクレジットカード情報、社会安全或いは他の国の国民識別番号、非公開の電話番号又は非公開の電子メールアドレスを含むが、これらに限定されない、個人情報や秘密情報を投稿する行為。
4.4 他人の個人情報、登録情報、利用履歴情報等を、不正に収集、開示又は提供する行為 。
4.5 本サービスを使用することで違法又は無許可の行為を行うこと。これには営業、宣伝、広告、勧誘、その他の営利を目的とする行為（当社の認めたものを除きます。）、性行為やわいせつな行為を目的とする行為、他のユーザーに対する嫌がらせや誹謗中傷を目的とする行為、その他の本サービスが予定している利用目的と異なる目的で本サービスを利用する行為を含みますが、これらに限定されません。
4.6 本サービスを改変、修正、改編、又は変動或いは他のウェブサイトを変更、修正、或いは変動することにより当該ウェブサイトが、本サービス又は当社に関係しているという誤解を引き起こす行為。又は、当社又は第三者になりすます行為或いは意図的に虚偽の情報を流布させる行為。
4.7 同一又は類似の商用メッセージ又は嫌がらせメッセージ（「スパムメッセージ」とも呼ばれます。）を不特定多数のユーザーに送信する行為（当社の認めたものを除きます。）、他のユーザーを無差別に友だち又はグループトークに追加する行為。
4.8 コンピュータワーム、ウイルス、スパイウェア、マルウェアなどその他の破壊的又は破壊的なコードの送信を含め、本サービス或いは本サービスに接続されているサーバーやネットワークに支障又は影響を与える行為。コンテンツ又はコードを挿入し、ユーザーのブラウザ或いはデバイスでの本サービスのレンダリング又は表示方法を変更或いは妨害する行為。
4.9 チートツール、その他の技術的手段を利用してサービスを不正に操作する行為、又は本サービスの不具合を意図的に利用する行為、同様の質問を必要以上に繰り返す等、当社に対し不当な問い合わせ又は要求をする行為、その他の当社による本サービスの運営又は他のユーザーによる本サービスの利用を妨害し、これらに支障を与える行為。
4.10 自動化されたデバイス、スクリプト、自動化されたプログラム、スパイダープログラム、カタログ化プログラム、又は取得プログラムの使用を含むがこれらに限定されない、許可されていない手段を通じて本サービスのアカウントを作成する行為。
4.11 他のユーザーが本サービスを利用又は享受することを阻止すること、或いは本規約又はその他の「個別利用規約」に違反するルートを奨励或いは提供することを試みる行為。
4.12 ユーザーのプロファイルや写真を含むがこれらに限定されない、カタログ化、取得、キャッシュなどの自動化された手段によって本サービスのコンテンツにアクセスする行為（当社が明示的に同意しない限り、標準の検索エンジンプロトコル又は技術を使用して検索エンジンで検索した結果）。
4.13 法令、裁判所の判決、決定又は命令、或いは法令上拘束力のある行政措置に違反する行為。
4.14 XnFunコンテンツを含む、又は付随する著作権、商標、サービスマーク、或いはその他の所有権に関する知らせを削除、変更、若しくは隠蔽する、又はXnFunコンテンツを再製、修正、改編、派生著作物を作成、演出、展示、出版、頒布、送信、放送、販売、利用許諾する行為、若しくはその他の搾取行為。
5. ユーザーの責任
5.1 本サービスを利用する際、ユーザー自身の関連情報の登録がある場合、ユーザーは真実で正確かつ完全な情報を提供する必要があります。お客様は、真実性及び正確性を維持するために、必要に応じて情報を更新することに同意するものとします。
5.2 お客様は、自分のアカウントを通じて発生する全ての行為に責任を負い、本サービスのアカウントはユーザーに対し一身専属的に帰属します。ユーザーの本サービスにおける全ての使用権利を第三者に譲渡、貸与、又は継承させてはなりません。従業員又は事業者に代わってアカウントを作成することが明示的に許可されていない限り、本サービスを利用する時にご自分以外の人のアカウント作成を代行することは禁止され、お客様はこの行為をしないことに同意するものとします。
5.3 本サービスを利用する場合、ユーザーは、不適切に使用されないように、ご自分のパスワードの秘密性及び安全性を保護する責任があります。このパスワードを使用して行った行為は、ユーザー本人の行為と見なされます。
5.4 お客様は、著作権法を含むがこれに限定されることのない本サービスの利用及びお客様の投稿コンテンツに適用される全ての法令・規制を遵守することに同意するものとします。
5.5 お客様は、本サービスの他のユーザーとやり取りした行為（オンライン又はオフラインを問わない）、及び全ての投稿を含むがこれらに限定されることなく本サービスで行った全ての行為及び結果に対して責任を負います。
5.6 当社の書面による事前の同意を得ることなくユーザー名に「XnFun」又はURLを使用することはできません。
5.7 本サービスの利用について、ユーザーは、必要なパソコン、携帯電話、通信機器、OS、通信方法、及び電気などを自己負担で用意し、本サービスの利用により発生するデータ伝送費用を自己負担するものとします。
6. 当社の権利の留保
6.1 ユーザーが本利用規約に違反した場合、又は違反のおそれがある場合、或いはその他の方法で当社に危害又は可能性のある法的リスクが生じる場合、事前の通知なしに当社は独自の裁量により、本サービスを利用するユーザーのアカウントを終了又はユーザーへの本サービスの一部或いは全部の提供を停止することができ、かつユーザーに対する責任を負わないものとします。ただし当社がこれら違反事態を防止又は是正する義務が課せられることを示すものではありません。
6.2 当社は、理由の如何を問わずいつでも本サービスを改訂又は終了する権利、或いは本サービスのユーザーを含むがこれに限定されない者が本サービスにアクセスすることを拒否する権利を留保します。当社は、理由の如何を問わずユーザー名を強制的に没収する権利を留保します。
6.3 XnFunの名称及びロゴは、当社の商標で、当社の事前の書面による同意を得ることなく、一部又は全部をコピー、模倣、或いは使用することはできません。当社のブランドガイドラインに適合するものは、この限りではありません。また、全てのウェブページの見出し、カスタム画像、ボタンアイコン、スクリプトはサービスマーク、商標、及び/又はXnFunの商標イメージであり、当社の事前の書面による同意を得ることなく、全部又は一部をコピー、模倣、或いは使用（本コンテンツを再製、転送、転載、変更などの行為を含む）することはできません。
6.4 私たちは、「本サービス」を変更及び改善し続けます。当社は、機能又は特徴を追加或いは削除する場合があり、特定の「サービス」を完全に一時停止若しくは中止する場合があります。
7. 免責事項及び責任の制限
7.1 本サービスは「現状のまま」及び「欠陥のある可能性」でお客様に提供され、お客様は本サービスの品質及びパフォーマンスにおける全てのリスクを負担するものとします。当社は、本サービスに明示的、黙示的、又は規制上の保証を提供しないことを明確的に示し、これには安全性、信頼性、正確性、完全性、有効性、特定の目的の適用性、間違い、又はプログラムエラー、及び知的財産権への非侵害を黙示的に保証又は規制の形で保証することを含みますが、これらに限定されません。これは、本サービスが完全に問題がないことを当社が約束することはできず、これらの欠陥を取り除いた後にユーザーに本サービスを提供する義務を負わないことを示します。
7.2 当社が本規約でユーザーの行動規範を提供したとしても、当社は投稿コンテンツを裏付けせず、何人又は実体のコンテンツによる損失又は損害（実際、派生的、懲罰的又はその他の原因と性質を問わない）、損傷、クレーム、損害請求について、当社は一切の責任を負わず、衡平法上の賠償を免除されることを特に表明します。
7.3 このような損害の可能性について当社に通知された場合でも、本サービスから生じる当社の全責任は、損害が発生した月に当社がユーザーから受け取った利用料の額を超えないものとします。
7.4 一部の法域では、特定の保証の免除、又は特定の損失に対する責任の制限又は免除を認めていません。したがって上述の免責事項及び責任制限条項の一部は、お客様に適用されない場合があります。 準拠法により、当社が黙示的な保証を免除されない又は責任を制限しない場合、かかる保証の範囲及び継続期間中の当社の責任の金額は、かかる準拠法で許可されている最低金額の範囲内に限られるものとします。
8. ユーザーの利用許諾
8.1 本サービスには、複数のユーザーが投稿、修正、削除などの編集を行うことができる機能が含まれている場合があります。この場合、ユーザーは、他のユーザーが当該ユーザー自身で投稿したコンテンツを編集できることに同意します。
8.2 ユーザーは、投稿コンテンツの全ての権利を所有していること、又は投稿コンテンツ内の必要な全ての権利を取得していることで、ユーザーが投稿コンテンツの権利を当社に付与できるようにすることを確保しなければなりません。ユーザーは、非独占的、支払い済み、ロイヤリティフリー、譲渡可能、再許諾可能な世界規模の許諾をここで当社に付与し、当社が適切と認めた方法又は目的（商用利用を含むがこれに限定されない。）で、ユーザーが本サービスのプライバシーポリシーに従って、投稿したコンテンツを使用、頒布、再製、修正、調整、リリース、翻訳、公に実施、及び公に展示する権利当社を持たせ、若しくはユーザーの投稿コンテンツに関連する広告を展示する権利を当社に持たせ、及びユーザーの投稿コンテンツを広告又は販促する目的で使用できるようにします。
9. 使用
9.1 当社は、ユーザーの投稿コンテンツについて所有権利がありません。当社は、当社が提供する本コンテンツについて使用権をユーザーに付与します。この使用権は、譲渡又は再許諾できず、かつ非独占的であり、本サービスを使用することのみを目的としています。
9.2 アカウントを終了させた場合、利用規約によってお客様に付与された全ての許諾及びその他の権利は直ちに終了します。ユーザーが誤ってアカウントを削除した場合でも、元のアカウントを復元することはできませんのでご留意ください。
9.3 一部のリンクは、本サービス又はお客様が本サービスから受信するメッセージからのものである場合があり、これらのリンクは、第三者のウェブサイト又は機能につながる場合があります。また、第三者のウェブサイト又は機能へのリンクが、画像或いはコメントの形式で本サービスに存在します。本サービスには、私たちが管理、維持、又は保証できない第三者コンテンツも含まれています。本サービスの機能により、本サービスが第三者のウェブサイト又は機能とのインタラクション(本サービス又はサービス上のお客様のプロファイルを第三者のウェブサイト又は機能のアプリにリンクすることを含む)を許す場合もあります。例えば本サービスには、本サービスに預かるコンテンツ、又は第三者に預かるコンテンツを共有できる機能があり、これらコンテンツは第三者のサービス又はアプリに開示されている場合があります。このような機能を使用する場合、通常、第三者のサービスにあるアカウントでログインするように求められますが、ログインした場合リスクを自ら負担することになります。当社は、これらの第三者ウェブサービス又はコンテンツを管理することはありません。お客様は、当社がこのような第三者のサービス又は機能に対して一切の責任又は賠償を負わないことを明知し、同意するものとします。本サービスを介した通信及びビジネス取引は、お客様と第三者との間でのみ行われます。お客様は、本サービス又は本サービス上のプロファイルを第三者のサービスとリンクするアプリ（「アプリ」という。）をご自身の絶対的な裁量権及びリスクの自己負担で使用することを選択できます。このようなアプリは、本サービスにおけるお客様のプロファイルとインタラクションし、リンクし、又はお客様のプロファイルからデータを収集及び/又は取り出し、或いはお客様のプロファイルにデータを転送する場合があります。このアプリを使用する場合、お客様は、下記の事項を確知し、同意したことになります。
(i) アプリを使用してデータを共有する場合、お客様は本サービスでのプロファイルデータが共有されることに同意することになります。
(ii) アプリを使用した場合、本サービス又は当社自体がこのようなデータを提供しなかった場合でも、個人を特定できる情報が開示され、かつ/又はお客様との関係が確立される場合があります。
(iii) アプリの使用はお客様自身の選択であり、お客様はリスクを自己負担し、アプリに関連する行為が当社に損害を与えないよう確保しなければなりません。
9.4 本サービスから削除されたコンテンツは、特定の法的義務の遵守を含むがこれに限定されない理由で、当社によって引き続き保存される場合がありますが、これらのコンテンツを取り出すには有効な裁判所命令が必要になる場合があります。ただし当社は、バックアップサービスではありませんので、お客様がコンテンツのバックアップ又は保存に本サービスを利用しないことに同意するものとします。
9.5 当社の方針は、当社が明確に定めるもの以外のコンテンツを受け入れない、又は検討しないことであり、かつこれらのコンテンツはいくつかの条項又は規定に適用する場合があります。これは、お客様のアイデアが私たちが開発した、或いは独自に開発したアイデアと同じという、誤解の発生を避けるためです。当社は、自主的に提供するデータやアイデアを受け入れず、このようなデータ又はアイデアについて一切の責任を負いません。お客様が当社の方針を無視して、本サービスを使用してコンテンツ、データ、アイデア、提案、或いはその他のデータを当社に転送することを決定した場合、お客様はさらに、当社がこのようなコンテンツ、データ、アイデア、提案、又はその他のデータを製品やサービスの開発やマーケティングを含むがこれらに限定されないさまざまな目的として自由に使用でき、お客様に賠償や料金を支払う必要がないことに同意することになります。
10. 賠償
お客様（及びお客様の本サービスにおけるアカウントの操作代行又は行為を行う第三者）は、本サービスの利用（本サービスでのお客様の直接的行為又はお客様の代理人による結果を含むがこれに限定されない。）によりもたらされるクレーム、損害や損失の責任及び費用(合理的な弁護士費用及び支出を含むがこれらに限定されない。)に対する補償または責任負担を当社が免除されることに同意及び保証します。お客様は、各種クレームの抗弁において当社の要求事項に全面的に協力することに同意するものとします。当社は、お客様が引き起こした賠償事項について独自の裁量権を留保し、当社の事前の書面による同意を得ることなく、お客様はクレームの他方当事者と和解してはなりません。
11. 準拠法及び紛争の裁判管轄
11.1 本規約は、中国語で作成されたものが優先され、中華民国法律を準拠法とします。これら準拠法は、動的な変化過程にある可能性があるため、準拠法に改廃が発生したことにより、本規約に基づくユーザー及び/又は当社の権利や利益が増減する場合、本規約の全部或いは一部の条項は自然に無効若しくは執行可能性を終了する根拠を構成しないものとしますが、改廃されたこれら準拠法が効力性や強制性の規定に属する場合、除外します。
11.2 本サービスに基づく、又は本サービスに関連するユーザーと当社の間の紛争については、紛争が発生した時に準拠法とポリシーにより、当社の所在地を唯一或いはうちのいずれかの紛争管轄区域とすることが許可されている限り、ユーザーは当社の所在地の管轄のある地方裁判所を当該紛争の専属的合意裁判所とすることに同意します。同時に、当社がユーザー又はその他の第三者に対して本サービスに係る紛争を提起する場合、当社は、当社の所在地の管轄のある地方裁判所を当該紛争の専属的合意裁判所として選択する権利を有するものとします。
12. その他
12.1 広告掲載：当社は、ユーザーの同意を得ることなく、又はユーザーに通知することなく、当社或いは第三者の広告を本サービスに掲載することができます。
12.2 業務提携パートナーのサービス：本サービスには、当社と業務提携のある他業者が提供するサービス又はコンテンツが含まれる場合があります。こられのサービス又はコンテンツの責任は、サービス又はコンテンツを提供する業者が負うものとします。上述の業務提携パートナーが提供するサービスについて、当社は一切責任を負いません。また、サービス又はコンテンツを提供する業者が定める利用規約及びその他の条件が、これらのサービス又はコンテンツに適用される場合があります。
12.3 連絡方法
(i) 本サービスに関し当社がユーザーへ連絡する場合、XnBay Technology公式サイト内の適宜の場所へ掲示するか、当社が適当と判断する方法により行います。
(ii) 本サービスに関しユーザーが当社へ連絡する場合、XnBay Technology公式サイト内の適宜の場所に設置するお問い合わせフォームに送信するか、当社が指定する方法により行っていただきます。
